This Refund Policy explains how billing, cancellation and refunds work for paid Deplion subscriptions provided by Bytech LLP (BIN 230740022607), 29A microdistrict, building 90, office 202, Aktau, Mangystau region, 130000, Republic of Kazakhstan, Republic of Kazakhstan.

It forms part of the Terms of Service.

1. Scope

1.1. This policy applies to all paid Deplion plans, including monthly and annual subscriptions and usage-based API billing.

1.2. The free plan involves no payment and nothing in this policy applies to it.

2. Who takes your payment

2.1. Payments are processed by Polar Software, Inc. (3500 South DuPont Highway, Dover, DE 19901, United States), which acts as Merchant of Record and seller of record for the transaction. Polar issues your invoice, collects the payment and handles applicable sales tax or VAT.

2.2. Polar's own terms and refund practices apply to the payment in addition to this policy. Polar may issue a refund at its own discretion, for example to resolve a payment dispute. This policy describes the position of Bytech LLP; it does not and cannot restrict what Polar is entitled to do as Merchant of Record.

2.3. Refund requests should be sent to us first at [email protected]. We can resolve most issues faster than a payment dispute can.

3. General rule — subscriptions are non-refundable

3.1. A Deplion subscription is a digital service that becomes available to you immediately upon payment. Fees already paid are non-refundable, including for a billing period that has only partly elapsed.

3.2. In particular, we do not refund because:

4. Cancellation

4.1. You can cancel at any time in Settings → Billing. No notice period applies and no cancellation fee is charged.

4.2. On cancellation, your plan benefits and limits remain in place until the end of the period you have already paid for. Automatic renewal stops.

4.3. No partial refund is issued for the remainder of the paid period. You keep the service you paid for until that period ends.

4.4. When the paid period ends, the account returns to the free plan and free-plan limits apply. This may make some projects unavailable if you exceed the free-plan allowance.

5. EU and UK consumers — statutory right of withdrawal

5.1. This Section applies only if you are a consumer — an individual acting outside your trade, business, craft or profession — resident in the European Union or the United Kingdom. It does not apply to business customers.

5.2. As a rule, you have 14 days from the conclusion of the contract to withdraw from a distance contract without giving a reason.

5.3. However, for the supply of digital content and digital services that begin during the withdrawal period, that right is lost once performance has begun with your prior express consent and your acknowledgement that you lose the right of withdrawal (Article 16(m) of Directive 2011/83/EU, and the corresponding provisions of UK law).

5.4. Before we start your subscription, we ask you to confirm exactly this. When you subscribe, you tick a box stating:

I have read the Refund Policy and I request that the service begins immediately. I acknowledge that I will lose my right of withdrawal once the service has started.

5.5. By ticking that box and completing the purchase you give express consent to immediate performance and acknowledge that your right of withdrawal ends as soon as the subscription is activated, which happens straight away.

5.6. If for any reason your subscription has not yet been activated, you may still withdraw within 14 days by writing to [email protected] with your account email and the order or invoice identifier from your payment confirmation.

5.7. This Section does not affect any other mandatory consumer right you have, including remedies where the Service is not as described or not of satisfactory quality.

6. Upgrades, downgrades and proration

6.1. Upgrading to a higher plan takes effect immediately and is invoiced immediately, with the amount prorated for the remainder of the current billing period.

6.2. Downgrading to a lower plan takes effect at the start of the next billing period. You keep the higher plan's benefits until then.

6.3. Prorated amounts already charged are not refunded if you later downgrade or cancel.

6.4. After a downgrade takes effect, free or lower-plan limits apply and content in excess of those limits may become unavailable.

7. Failed payments

7.1. If a renewal payment fails, your plan entitlements are maintained for a short grace period (currently 7 days) while the payment is retried.

7.2. No refund is due for that grace period — the service remained available to you.

7.3. If payment is not completed by the end of the grace period, the account is downgraded and free-plan limits apply.

8. Termination for breach

8.1. If we restrict, suspend or terminate your account because you breached the Terms of Service or the Acceptable Use Policy, fees already paid are not refunded and any remaining paid period is forfeited.

8.2. If we terminate your account for convenience rather than for breach, we refund the prepaid amount covering the unused remainder of your then-current billing period.

9. Discretionary refunds

9.1. We may issue a refund at our discretion where the circumstances clearly warrant it, for example:

9.2. A discretionary refund in one case does not create an entitlement, a precedent or an obligation to grant one in any other case.

10. How to request a refund

10.1. Write to [email protected] and include:

10.2. We aim to review requests within 10 business days and will tell you the outcome by email.

10.3. Approved refunds are returned through Polar to the original payment method. The time it takes to appear on your statement depends on your bank or card issuer.

11. Chargebacks

11.1. If you believe a charge is wrong, please contact [email protected] first.

11.2. Starting a chargeback or payment dispute without contacting us first entitles us to suspend your account immediately, including unpublishing your sites, until the dispute is resolved.

11.3. We may decline to provide the Service in future to accounts associated with an unresolved or abusive chargeback.

12. Your statutory rights

12.1. Nothing in this policy limits or excludes any right you have under mandatory consumer protection law that cannot be waived by agreement.

12.2. Where a provision of this policy conflicts with such a right, that right prevails and the rest of this policy continues to apply.
